I was at intersection in Dallas, TX. A guy wasn’t looking and bumped my car from behind. Not much damage, just some paint coming off my bumper. I got out, got his driver’s license and insurance information. He seemed very helpful. I filed my report and a few days later it came back denied. The guy claimed that I had gone too far forward at the intersection and backed up to get out of traffic. He says when I backed up, I hit his car. We were both alone and there were no other witnesses. What is my next step and what are my chances?

Get an attorney if you feel it is worth it, but it probably is not if the damage is that small. Best bet in the future is to have under-insured motorist on your policy, and to wait for law enforcement to arrive at any accident, it is your right. Law enforcement is pretty good at picking out the liar in these situations, trust me, I’ve been there.

report it to your insurance company, they will battle it out with the other party’s insurance, they too can tell if who is lying. If he gave you his insurance information, he has basically admitted fault.
