It was a raining on that friday night. i was driving on I-635 towards irving. there was a stranded(or the vehicle already been in accident) on my left lane(lets say CAR A). there was a another car(lets say car B) which was driving on the same left lane. at the last mininute, CAR B noticed the CAR A just before few feets aways and CAR B merged into my lane giving me no time to react. in order to save myself from accident with car B. i applied brake, my car got skid and ended up hitting with another car on my right lane(CAR C).
CAR B didn’t stopped. my insurance says that as i didn’t hit CAR A and B, i am at fault for hitting car C. how is that my fault? i am at accident because of CAR A and CAR B.
is it really my fault? i saved mine and somebody(s) life that day. it looks like i am at fault for saving life of those careless driver CAR B. i live at dallas-tx
Me and Driver of CAR C were driving below the speed limit.

Speed and all the other factors don’t matter if there was no contact between you and the “at fault” vehicle. If you would have made any contact it would have been his fault.

Well, CAR C can’t be at fault for their damages because they were just driving in their lane not doing anything wrong and you either swerve or skidded into them. Somebody has to be responsible for their damages and since your car made contact with their car, that’s on your insurance. CAR B or CAR A can’t be responsible because they didn’t make contact with CAR C. I think it says in most liability policies that there has to be contact with another vehicle for there to be a valid claim. If you hit CAR B when it cut you off, then that would be different and if somehow CAR C got hit too, then maybe CAR B would be at fault for both car’s damages.
